COMPLEX DEALS
Buying a car not in the seller’s name in Texas
The name mismatch
The person with the keys is not the person on the title. Estate. Company. Spouse. A skipped transfer from two owners ago. An out-of-state owner who “will sign later.” Walking is the default amateur move. Closing is possible when the chain can be documented before money moves.
A bill of sale from someone who never owned the car is not a chain. It is a piece of paper that will bounce at the county.
Estate, company, skipped transfer
An estate needs the person with authority — executor, administrator, or heir under a path the county will actually accept — plus the death paperwork the tax office expects. A company title needs a person who can bind that entity, not a employee with a LinkedIn title. A skipped transfer is a stack of assignments. Each missing owner is a missing signature, not a vibe.
Out-of-state owners can sign. They have to sign the right document, in the right capacity, on the title that exists. “My cousin in another state has it” is a logistics problem if it is true, and a dead deal if it is not.
What has to be true before you wire
You need the last issued title (or a bonded-title plan you understand), the VIN on the metal matching that title, and a signer whose authority you can explain to a clerk. If a lien is open, payoff is part of the chain. If the title is lost, you are not doing a casual private-party deal anymore.
This overlaps title in transit when the right person exists and the paper is simply late. It is a different file when the right person does not exist on paper.
Buyer’s side, not a pep talk
Provenance works that stack for Texas buyers in Austin, Houston, Dallas, and San Antonio. We do not invent ownership. If a name is missing, we stop or we take the bonded or court path with the cost and delay in the open.
The car might be a used Ferrari, a BMW M car, or a Porsche with a messy garage history. The paper problem is the same. Start an acquisition with the VIN and the last name on the title.
