Buying a car with a title in transit in Texas
What “title in transit” means
In Texas, the phrase usually means the seller does not have the physical title when you want to buy. It may still be at a prior lender, at a dealer, or in the mail from a county or TxDMV. The car can be sitting in a driveway in Houston or Dallas. The paper is late. That delay is where private-party deals collapse, or where people wire money they cannot unwind.
A tracking number, a screenshot, or a “it’s coming Friday” text is not a title. Texas transfer still needs the assigned title (or a bonded or court path if the title is truly gone). Treat those substitutes as evidence of a process, not as the process itself.
Where the title actually is
Lender payoff is the common case: the seller traded or sold the car before the lien release produced a new title. Dealer-to-dealer or out-of-state purchases add another hop. Estate and company cars add people who have to sign in the right capacity. None of that is exotic in the mechanical sense. It is slow, and it is specific.
Ask for the named owner on the last issued title, the VIN, the lienholder if any, and who is shipping what to whom. If the seller cannot answer those without improvising, you do not have a title-in-transit file. You have a story.
How a purchase still closes
Staged funds or escrow beat “pay in full and wait.” Possession without a paper trail is how you end up with a car you cannot register. Confirm the VIN on the car matches the VIN on whatever document the seller claims is moving. If a lien is involved, confirm payoff with the lienholder, not with the seller’s memory.
When the title arrives, the named owner (or a person with actual authority) assigns it. If the name on the arriving title is not the person who took your money, you have a different problem: a car not in the seller’s name.
